The Islamabad High Court on Wednesday did not grant immediate relief to 20 sub-lease holders and apartment owners of One Constitution Avenue in a case arising from the cancellation of the project’s main lease.
A division bench comprising Justice Muhammad Azam Khan and Justice Inam Ameen Minhas heard intra-court appeals filed by several affected individuals, including former air chief Mujahid Anwar Khan, former ICC president Ahsan Mani, former Senate chairman Wasim Sajjad, and others.
The appellants challenged the earlier ruling to the extent of paragraph 30, seeking protection of third-party rights linked to the property.
During the hearing, advocates Taimur Aslam and Ali Raza represented the appellants, while Kashif Ali Malik appeared on behalf of the Capital Development Authority.
The court observed that the case before it concerned the rights of the affected owners rather than BNP.
In response, CDA’s counsel told the bench that the authority’s board would decide the matter in accordance with the law.
The court directed the CDA to obtain instructions and submit a written response. The hearing was then adjourned until May 25.
The case is significant for the affected apartment owners and sub-lease holders, as the court’s eventual decision could determine the legal protection available to third parties following the cancellation of the main lease.
