The Islamabad High Court (IHC) has set aside the ban on the purchase, sale, registration, and transfer of properties in several localities of the federal capital, including Shah Allah Ditta, Sangjani, Sarai Kharbooza, and other notified areas, allowing lawful transactions to resume.
The ruling was issued by Justice Muhammad Asif while accepting a petition filed by Fazal Abbas. The court held that the restrictions imposed on December 1, 2023, had not been approved by the competent authority and therefore lacked legal validity.
In its detailed order, the IHC directed the relevant authorities to regulate property transactions under the provisions of the Capital Development Authority (CDA) Ordinance, Islamabad Capital Territory (ICT) regulations, and other applicable laws. The court stressed that all future transactions must remain subject to the existing legal and regulatory framework.
At the same time, the court made it clear that the decision does not limit the powers of government agencies to act against illegal housing societies, unauthorized construction, or unlawful changes in land use. Authorities can continue taking action against any violations in accordance with the law.
The judgment also reaffirmed that while the blanket restriction on property transactions has been removed, enforcement agencies retain full authority to proceed against illegal housing projects and other unauthorized developments wherever legal action is warranted.
